NOTICE OF PUBLIC HEARING

Pursuant to Section 76-2-402(2), MCA, NOTICE IS HEREBY given that the City Council of the City of Boulder will hold a public hearing on Monday, August 29, 2022, at 6:30 p.m.  at City Hall, located at 304 N. Main St. The Council will consider the provisions under that certain 2019 Lease Agreement with the Animal Shelter Care Committee related to the proposed construction and use of an animal shelter.  The proposed shelter will accommodate five holding kennels for dogs, and several for cats, depending on the layout, and provide for access by a road constructed for such purpose. The leased property is described as:  A triangular piece of property, (501 feet along Muskrat Lane, 439 feet along the fence next to the WWTP, and 707 feet along the chain-link fence on state land), approximately 2.6 acres, located south of the City’s wastewater treatment plant on Muskrat Lane.

The Animal Shelter Care Committee applied for a zoning permit on July 27, 2022, to place a 20’x35’x10” concrete slab and garage of the same size on the property for the purpose of housing animals. The permit was reviewed for compliance on August 4, 2022, with the finding being the city’s property is currently zoned as R-2, which per current ordinances does not allow for the construction of an animal shelter.
